MISUSED AND ABUSED PRODUCT

Over the years, Worker tools and service equipment have earned a reputation for world-class quality, superior workmanship, and professional-grade durability. When properly used and conscientiously maintained, Worker tools can provide you their full lifetime of reliable service. However, this is not to say that our tools are indestructible. When subjected to intentional physical misuse and abuse, even Worker tools can break or fail prematurely.

Worker tools and Worker Distributors recognize that the warranty coverage for our tools and equipment has a significant influence on your decision to purchase and use Worker product. We also recognize that the intentional misuse and abuse of hand tools continue to be a common concern to us all. As a result of both consideration, Worker has structured our warranty policies. However, not applicable to products which have been obviously and intentionally misused and abused. As service to you, our customers, and in concern for your safety, Worker provides the following examples to illustrate common misuse and abuse practices. To make the most of your Worker tools and the Worker Warranty, we encourage you to avoid these practices.

Bent Shanks and Tips
indicate their use as Pry Bars.
Screwdrivers are NOT intended to be used in this manner.

Use heavier duty Pry Bars for these applications.

Broken Tips and Hammer Marks on Screwdrivers indicate their use as chisel.

Use the appropriate chisel and tip configuration for use with striking tools.

Rounding or mushrooming on all four corners of a square drive and sidewall cracks indicate use with a power tool.
NOTE: Chrome-plated hand tools of any kind are NOT intended to be used with power tools
Use impact sockets ONLY for power tool applications.

IMPORTANT NOTICE: The following examples of flagrant abuse of products are conditions that void the Mr Mark warranty. Please be advised that Mr Mark will NOT honor any warranty claim for products subjected to such obvious physical abuse.

Any tool or part branded with the Worker Tools (Worker) name is warranted against defects in materials and workmanship. Worker, or one of its authorized representatives, will, at Worker option, repair, or replace, any tool or part bearing Worker name, without charge. If the defective or malfunctioning tool or part is returned to Worker or one of its authorized representatives, shipping prepaid. Please be sure to include your name and address with the tool or part, and describe the nature of the problem.

Worker shall have no obligation in pursuance of the Worker warranty with respect to any tools or parts which in Worker sole judgement have been altered, damaged, misused, badly worn, lost or improperly maintained. This warranty is null and void if the customer, or any other person other than any authorized representative of Mr Mark, has made any attempt to service or modify the tool prior to its return to Worker under this warranty.

All products sold by Worker to its Distributors have been assigned a warranty code in the Worker Price List. The limited warranty provision with respect to each such product shall be the limited warranty designated in this warranty agreement and may be Worker from time in its sole discretion.

Worker Tools reserves the right to make periodic changes in construction or tool design at any time. Worker specifically reserves the right to make these changes or updates in tools or parts previously distributed.

The Worker warranty is in liue of all other warranties, expressed or implied, including any warranty of merchantability or fitness for a particular purpose, and sets forth the sole and exclusive remedy in contract, tort, strict liability, or otherwise. Under no circumstances shall Worker warranty be liable for any special, incidental, or consequential damages.

Note: Some states do not allow the exclusion or limitation of incidental or consequential damages. The Mr Mark warranty confers specific legal rights. The purchase may have other right which vary from state or outside the United States of America.

No Worker employee, distributor or other person, other than an authorized officer of Worker, may extend the Worker warranty. Any such alteration must be in writing and signed by such officer.
